1. Agreement to Terms These Terms & Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and California Gold & Silver Exchange (“Company,” “we,” “us,” or “our”), concerning your access to and use of the https://cagoldandsilver.com/ website (the “Site”) as well as any services provided at our retail location located at 130 S Mountain Ave, Unit R, Upland, CA 91786. By accessing the Site or doing business with us, you agree that you have read, understood, and agreed to be bound by all of these Terms & Conditions.
2. Market Risk and Investment Advice Purchasing precious metals involves inherent risks. The market for gold, silver, platinum, and palladium is volatile and prices will fluctuate.

Assumption of Risk: You acknowledge that the value of your purchase may go up or down and that you are solely responsible for your investment decisions.
3. Pricing, Orders, and Payment

Live Pricing: Prices for bullion and coins on our Site or quoted in-store are based on live market prices and are subject to change without notice until an order is firmly placed and a price is locked in.

Order Finality: Once an order is submitted and a confirmation is issued (a “locked-in” price), the transaction is binding.

Payment Terms: We accept various forms of payment, which may include wire transfers, checks, credit/debit cards, and cash (in-store only). Depending on the payment method, your order may be subject to a clearing period (e.g., up to 10 business days for personal checks) before physical metals are released or shipped.
4. Cancellation and Market Loss Policy Because we hedge our inventory based on your locked-in order, we maintain a strict cancellation policy.

If you choose to cancel your order, or if you fail to provide payment within the specified timeframe, you will be responsible for a cancellation fee as well as any market loss we incur.

Market Loss: Market loss is calculated as the difference between your locked-in purchase price and the current market value of the metals at the time of cancellation.
5. Shipping and Risk of Loss

All shipments are fully insured during transit.

Risk of Loss: The risk of loss and title for items pass to you once the carrier marks the package as “Delivered.” It is your responsibility to ensure you have a secure location for delivery.

If a package is lost or damaged in transit, you must notify us immediately so we can file a claim with our insurance provider. Do not discard any packaging materials.
6. Return Policy Due to the volatile nature of the precious metals market, all sales of bullion (gold, silver, platinum, palladium) are final. We do not accept returns.

Buyback Policy: While we do not accept returns, we are always actively purchasing precious metals. If you wish to liquidate your metals, we will offer to buy them back from you at our current daily bid price, which may be higher or lower than your original purchase price.

Numismatic Discrepancies: If you believe you received a different item than what was described, you must contact us within 3 business days of receipt to resolve the issue.
7. Compliance and Anti-Money Laundering (AML) We strictly comply with all local, state, and federal laws, including the USA PATRIOT Act and Anti-Money Laundering (AML) regulations. We reserve the right to require government-issued identification, request a social security number, or file IRS Form 8300 for cash transactions exceeding $10,000, or for any transaction we deem suspicious.
8. Intellectual Property The Site and its original content, features, and functionality are owned by California Gold & Silver Exchange and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
9. Limitation of Liability In no event will California Gold & Silver Exchange, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site or our services; (ii) any conduct or content of any third party; or (iii) fluctuations in the precious metals market.
10. Governing Law and Dispute Resolution These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of our services shall be resolved in the state or federal courts located in San Bernardino County, California.
